Minutes of an Ordinary Meeting of Holme Parish Council held on Tuesday 31st August 2010.
NOTE: THESE MINUTES ARE NOT ACCEPTED AS A TRUE RECORD UNTIL SIGNED AS SUCH BY THE CHAIRMAN AT THE NEXT MEETING OF THE COUNCIL.
Present: Cllr Medwin Sherriff (Chairman); Cllrs Brian. Cooper; Neville Parker; Terry Wilkinson &

10.8 Apologies: Cllr Edwin Duckett & Cllr Lynne Gibbons.
10.8.1 Declarations of Interest: Cllr Cooper declared a Personal Interest in Minute 8.9.1 (Application SL/200010.0671).
10.8.2 The Minutes of the Meeting held on 27th July 2010 having been circulated to all Cllrs, these were accepted as a true record and signed as such by the Chairman.
10.8.3 There were no Matters Arising from the above Minutes.
10.8.4 Matters raised at the Open Session:
8.4.1 Dog-fouling – Sheernest Lane: See Minute 8.7.1
8.4.2 Advertising Boards on roads leading into village: The SLDC Enforcement Officer will be contacted to see whether permission has been received for these signs.
8.4.3 Lack of White-lining on roads throughout area: Cllr Bingham will speak to Highways.
8.4.4 ‘A’ level & GCSE Results: Cllr Bingham said that the Council should know that Cumbria was now one of the best achieving areas in England.
10.8.5 Finance & Legal:
8.5.1 It was resolved to pay the following:
Bigfish (up date to Web Site); £70.00
Clerk’s Salary.
Parish Lengthsman: £316.25
Holme Parish Hall: £26.00
8.5.2 The Clerk confirmed that the Annual Audit for 2009/2010 had now been carried out by BDO and that there were no matters arising.
10.8.6 Parish Council Surgeries:
8.6.1 Matters raised:
A, Difficulties raised by residents in moving waste bins, etc: Cllr Bingham stated that it was possible to arrange for a doorstep collection of bins. A notice will be printed in the Newsletter giving details of contacts at SLDC,
B. Pear Tree Park – Kick-about Area: Following enquiries to Russell Armer; it is confirmed that this area will be cleared shortly and the porta-cabins will be reduced to one storey and painted green.. However, stone on the site will have to remain temporarily until another location is found.
8.6.2 Date of next Surgery: Saturday September 18th.
8.6.3 Cllrs Wragg & Sherriff will attend.
10.8.7 Resolutions, etc on Village Matters:
8.7.1 Dog-fouling Notices: Holme is on the list for dog-fouling notices and it is hoped that these will be in place shortly. Following complaints from a householder at Holme Mills, it was confirmed that the Lengthsman cannot clear the land in question as this is not Council property.
8.7.2 Web Site & Parish Plan: Amendments have been made to the Web Site and the Parish Plan page is now up-dateable. The Clerk’s address has been removed from the Web Site.
8.7.3 Parish Paths: Further developments:
a. Landlord Consent (1) Now received from Russell Armer in respect of installation of kissing-gate, etc. The Lengthsman has confirmed that there should not be a problem with installation of this gate and renewal of the fence and a price is awaited.
b. Landlord Consent (2): Confirmation is awaited from the second Landowner following a meeting with the Chairman and Cllr Wragg. The Landowner would like to see the footpath moved back to its original course neared to the field boundary.
c. Bull Coppice Lane: The Lengthsman will be asked to cut back grass, etc., on this lane up to the School entrance.
8.7.4 Rubbish Collection – The Square: It was confirmed that these bins should be emptied weekly. However, bags of household waste are being left by the bins. Environmental Health is aware of this situation.
8.7.5 Trees on Milnthorpe Road: Cllr Duckett and the Lengthsman are dealing with this matter.
8.7.6 Trees on Burton Road: Cllr Duckett and the Lengthsman will deal with this matter.
8.7.6a Tree on Pear Tree Park: Following a complaint from a resident, Cllr Duckett will deal with this
matter.
8.7.7 Highway Matters: None raised.
8.7.8 Advertising of date of Parish Hall AGM Cllrs Wragg & Gibbons will raise this matter at the next meeting of the PHMC.
8.7.9 Stone at entrances to village: Information from Holme Park Quarry indicates that the initial work will commence on Wednesday 8th September and the stones should be in place shortly after that date. The Chairman of Holme WI has asked the Parish Council Chairman to liaise directly with the Quarry on this matter. The Clerk asked for some indication of the value of these stones as they will need to be added to the Insurance Policy. The original signs at the entrances to the village (which are the property of the Council) will be retained and one will be erected on Moss Lane.
8.7.10 Flooding on North Road: (Old Lane; Meadowcroft; Junction/Pear Tree Park; etc); Confirmed that the gully cleaner has been in the village but that there are some gullies which still need to be cleared. There is a possibility that some of the problems are caused by collapsed gullies and this will be confirmed.
8.7.11 Motorway Bridge: Safety Concerns: Following a complaint from residents that the guardrail at the eastern end of the bridge was insufficiently secure to keep our children or animals; Amey Mouchel took immediate action and improvements have been carried out.
8.7.12 Vandalism on Canal Towpath:
a. Horse-riders: Following an incident involving horse-riders being seen to cut through the barbed-wire at the North Road end of the canal, British Waterways were informed and, although no direct response has been received, a temporary notice has appeared which states that horse-riding is not allowed on the canal towpath.
b. Fishermen: Following reports that fishermen have been seen removing the gate at the North Road end of the canal, British Waterways have been informed and asked to secure this gate at both sides to prevent this occurring again.
8.7.13 Stage Coach temporary bus service: Trevor Pennington of Stage Coach has been thanked for the efficiency of this service whilst the A6070 was closed in Burton and was asked to thank their driver who had amended the original timetable slightly so that passengers would not have to wait long at Ackenthwaite for their connection.
8.7.14 Street Light on North Road: Following a complaint from a resident regarding a new light which had been installed, it was confirmed that this was the latest type of white light which was more cost-efficient that the previous types – although the fitting supplied was not the correct one. The resident also complained about the number of workmen which it took to replace this light. However, Highways have confirmed that it does not matter how many men are involved in the work as the contract cost is still the same.

8.10.3 E-mail information received by the Chairman from the Police:
a. Following reports of telephone calls from SAS Fire & Security Ltd, residents are urged not to deal with any security matters on the telephone.
c. There are concerns about people conducting a Crime Prevention Survey locally. Police say do not allow anyone to enter your property under the guise of offering a crime prevention service.
d. Residents should be aware of a BT Telephone Scam regarding outstanding payments to BT. Allegedly your telephone connection will be cut if you do not pay. Ignore this – it is a scam.
e. It in any doubt about any of the above or other matters of concern, residents should telephone the Police on 0845 330024. This telephone number also appears in the Parish Magazine.
10.8.11. DATE OF MEETING: The next Ordinary Meeting of Holme Parish Council will be held on Tuesday September 21st at 7.30 pm in Holme Parish Hall.
There being no further business, the Meeting was closed at 8.45pm.

10.7 Apologies: Cllr Sue Wragg & Cllr Roger Bingham (SLDC & CCC)
Prior to the Opening of the Meeting proper, the Chairman welcomed the new Community Police Officer who reported that there had been no crime in Holme during the last month. It was confirmed that no particular time had been designated for visiting Holme but that all the necessary contacts were in the Newsletter, There was a request for the Speed Monitor in the village on both North Road and Burton Road and this was noted.
10.7.1.Declarations of Interest: Cllr Cooper declared a Prejudicial Interest in Minute 7.7.8 (Holme Bowling Club) and an Interest in Planning Minute 10.7.9 Holme Sports & Community Centre.
10.7.2.The Minutes of the Meeting held on 29th June 2010 having been circulated to all Cllrs, there were accepted as a true record and signed as such by the Chairman.
10.7.3.Matters Arising: No Matters Arising.
10.7.4.Matters raised at the Open Session:
7.4.1 Planning: Cllr Cooper confirmed that there was Disabled Access to the new Toilet Block on the Community & Sports Field and that this a temporary building until such time as a permanent structure was in place.
7.4.2 Parish Plan; Website, etc: Carried forward to the Agenda of the August Meeting.
7.4.3 Parish Hall Annual General Meeting – Publicity issues: Carried forward to the Agenda of the August Meeting.
10.7.5.Finance & Legal:
7.5.1 It was resolved to pay the following:

Swing Seats on Children’s Play Area: Paul Bennett: £310.00
10.7.6.Parish Council Surgeries:
7.6.1 Matters raised at the Surgery held on 17th July:
Waste Bins: Emptying. It was questioned whether these bins were emptied on a weekly or a fortnightly basis. It was pointed out that a larger bin was needed next to Lime Tree Stores rather than on the side of The Square adjacent to the bus stop.
7.6.2. Date of next Surgery: Thursday 19th August.
7.6.3. Cllr Parker & Wilkinson will attend.
10.7.7 Action in regard to Parish Matters:
7.7.1 Dog-fouling Notices: Still awaited.
7.7.2 Bus Time Table during road closure: Now in Post Office, LimeTree Stores and on the Parish Council Notice Board.
7.7.3 Parish Paths: A response is awaited from the Landowner of the fields where the Council wishes to improve the stiles, etc. Information has been passed on to Russell Armer regarding the fence which they wish to install between the kick-about area and grazing land. It is confirmed that the Lengthsman has £5m Public Liability Insurance which is acceptable.
7.7.4 Grass-cutting – Pear Tree Park: This area has now been taken over by the SLDC. A question was raised as to whose responsibility it was to maintain a small plot of land within Pear Tree Park.
7.7.5 Grass Verges: Following a meeting with Steve Gibson of CCC, there was still doubt as to whether this was owned by the SLDC; the County Council or the owners of the properties. So far no information is to hand from investigations at the Land Registry.
7.7.6 Trees on Milnthorpe Road:
a. Following a letter regarding trees overshadowing properties, Cllr Duckett and the Lengthsman will inspect the trees in question.
b. Following a complaint regarding children stripping bark from the Ash Tree on The Green on Milnthorpe Road, Cllr Duckett has applied a product to the tree which may be a solution to this problem.
c. Regarding the Rowan Trees on North Road, it is possible that these are diseased and Cllr Duckett will make further enquiries.
7.7.7 Work carried out by Cllr Duckett and his sons: The Chairman wished to put on record the valuable work which was done by Cllr Duckett and his sons during the bad weather in January as regards storing; bagging and distributing sand/salt. They also collected the remaining sand when it was no longer required. Cllr Duckett also removed the soil and bark from the Children’s Play Area prior to the installation of the new surface and removed soil from the School area when work was carried out there. The Council thanked Cllr Duckett for all his continuing efforts on behalf of the Parish.
7.7.8 Bowling Club: (Cllr Cooper left the Meeting as he had declared a Prejudicial Interest in this matter.) It was unanimously agreed that the Parish Council had no objections at all to the advertisements on the east wall of the Bowling Club and the Clerk will write to the Club accordingly.
7.7.9 Stones to be placed at entrances to the village: As the Contractor has now confirmed his Insurance Cover and this has been forwarded to John Bell at Highways, it is hoped that work can proceed to put the stones in place shortly.
7.7.10 Flooding on North Road: During the recent bad weather, there was flooding in several areas of North Road (Old Lane; Meadowcroft: entrance to Pear Tree Park & near Brooklands). At a meeting with Steve Gibson, who inspected all the drains on North Road, it was agreed that these would be cleaned and SLDC asked to liaise with County so that street cleaning was carried out at the same time.
10.7.8 Reports on Meetings:
7.8.1 Meeting with Martin Nicholson (Russell Armer); Following discussion regarding the proposed bridge over the beck on Pear Tree Park, Russell Armer will now liaise with the County Council.,
7.8.2 Meeting with United Utilities o Children’s Play Area: This was an excellent meeting and the representatives from United Utilities were delighted with the resurfacing which had been carried out. Photographs were taken and a report was in the Westmorland Gazette. United Utilities will supply a plaque to show that this work was carried out with their funding and the School will be asked for permission for this to be placed on their wall.

10.6(2).4 Matters raised at the Open Session:
6(2).4.1 It was noted that Cllr Duckett reports that the trees near to Town Head Fold which had been planted by Holme W.I. appear to be dieing – possible due to lack of water.
6(2).4.2 The Lengthsman will asked to cut the grass on the Children’s Play Area.
6(2).4.3 Cllr Duckett drew the Council’s attention to the proposals by Cumbria County Council and the National Park to close the road on the west side of Thirlmere to vehicular traffic.
10.6(2).5 Finance & Legal:
6(2).5.1 It was resolved to pay the following:

6(2).5.2 Registration of Financial Interest Forms were returned to the Clerk.
10.6(2).6 Parish Council Surgeries:
6(2).6.1 Surgery held on Thursday 17th June:
a. Stile on footpath – Pear Tree Park: (See Minute 10.6(2).8.2)
b. Grass-cutting Pear Tree Park: SLDC will be asked for their grass-mowing schedule for this area.
c. Grass on verges – North Road: It was resolved that no further survey of the residents should take place at present. Further information is being sought on the ownership of this grass verge.
6(2).6.2 Date of next Surgery: Saturday 17th July.

10.6(2).7 Resolutions on action to be taken on Village Matters:
6(2).7.1 Dog-fouling Notices: SLDC are awaiting delivery of further signs which are particularly necessary for Sheernest area.
6(2).7.2 Sub-Station – North Road: It has been confirmed by United Utilities that, after investigation, they can find no explanation for this noise.
6(2).7.3 Raised Area on The Square: It was generally agreed that work was necessary on this area and it was suggested that this might form part of a Jubilee Project for the village.
6(2).7.4 The Square: It was agreed that car parking was much improved since the white-lining has bee carried out.
6(2).7.5 Bus Services: The Clerk will contact Trevor Pennington of Stagecoach to see what plans have been made for the bus service whilst the road in Burton is closed for re-surfacing.
6(2).7.6 Proposed new Footbridge over Holme Beck on Pear Tree Park: A meeting has been arranged with Martin Nicholson of Russell Armer and Keith Masser of Cumbria CC to discuss this matter.
6(2).7.7 British Waterways have been contacted regarding the tethering and grazing of horses on the canal towpath.
6(2).7.8 Rubbish Bin on The Square: Following complaints, this has now been emptied.
6(2).7.9 Various Highway Matters:
a. Sightline on North Road: Martin Elson (CCC) will be contacted and asked to re-open the matter of the hedge.
b. Narrow area – North Road: Suggest that some kind of warning sign is provided in view of increased traffic.
c. Verge on North Road: (See Minute 6(2).6.1c)
d, Moss Lane: Repairs will be completed when road repairs are carried out in Burton.
e. Corner of Burton Road opposite Turnpike Lane: This will be carried out as part of the on-going repair programme.
10.6(2).8 Reports on Meetings:
6(2).8.1 Neighbourhood Forum: Cllr Gibbons was unable to attend.
6(2).8.2 Parish Paths Partnership: Following a meeting with Andrea Bonacker, it was agreed to carry out the following work providing agreement is received from the Land Owners. – Footpath 533004.
a. Install a gate on the footpath at Pear Tree Park; improve ground on opposite side of the stream and improve access via stone bridge;
b. New Fence to be erected by Russell Armer; Installation of gate is the responsibility of Russell Armer;
c. Gate at end of Russell Armer property: Install a gate & leave stone stile in situ.
d. It is hoped to improve more areas of this footpath in future.
e. David Holmes is suggested as the contractor and will be asked what amount of Public Liability Insurance he holds.
6(2).8.3 Village Marker Stones: A meeting took place with representatives from Holme W.I; the contractor who will be putting the stones in place; the Manager of Holme Park Quarry; John Bell of CCC Highways; Parish Cllrs & the Clerk. These stones will replace the present village signs on Milnthorpe Road; Burton Road and North Road. It is suggested that the present signs are positioned on Moss Lane and Station Road at Holme Mills. Installation will take place shortly.
10.6(2).9 Planning:

10.6(2).11. DATE OF MEETING: The next Ordinary Meeting of Holme Parish Council will be held on Tuesday July 27th at 7.30 pm in Holme Parish Hall.

Present: Cllr M. Sherriff (Chairman); Cllrs E. Duckett; L. Gibbons; N. Parker; T. Wilkinson & S. Wragg.
10.6 Apologies: Cllr. B. Cooper.
10.6.1 There were no Declarations of Interest.
10.6.2 The Minutes of the Annual Meeting held on 4th May having been circulated to all Cllrs, these were accepted as a true record and signed as such by the Chairman.
10.6.3 There were no Matters Arising from the above Minutes.
10.6.4 Matters raised at the Open Session:
6.4.1 Mrs Maureen Hewitt, President of Holme WI, updated the Council regarding the engraved stones which are to be erected at entrances to the village. One of these stones is now complete and a photograph was circulated. The Council agreed that the workmanship on the stones was excellent and, as soon as the remaining stones are completed, arrangements will be made for members of the Council and the WI to meet with Highways to confirm exactly where they are to be placed.
6.4.2 Potholes: Various potholes in the village have now been repaired following a report from Cllr Wragg to the Highwayman.
6.4.3 Queen’s Jubilee: These is no confirmation as yet as to what form any celebrations will take but the Council will bear in mind possible costs when the Precept for 2011/2012 is prepared in November this year.
10.6.5 Standing Orders: Following discussion, it was resolved by a unanimous vote of the Council that the following Standing Order be added to existing Parish Council Standing Orders (in accordance with Standing Order 30):
Standing Order: 31: Actions to be taken following any request that the Parish Council submit either an Outline or a full Planning Application on behalf of a local Charity or Community Group:
‘Following discussion, an agreement and a vote in favour by a majority of the Council, should Holme Parish Council then agree to submit an Outline or a full Planning Application on behalf of a local charity or community group, the Council reserves the right, without prejudice, to comment on the application in its role as a Parish Council, even though it could be regarded as an interested party. By agreeing to enter a Planning Application on behalf of any local charity or community group, there is no implication of automatic support by the Parish Council for any such application as there could be, and frequently is, opposition from other parties.
There is to be no compulsion on the Council to submit any Planning Application as, in fact, such an Application could be considered to be bad practice unless it was a joint project between the Parish Council and the charity or community group involved. It is entirely a matter for the Parish Council to decide whether they wish to submit a Planning Application and the Council's decision following a vote taken at an Ordinary Meeting of the Council is final.’
10.6.6 Finance & Legal:
6.6.1 It was resolved to pay the following Accounts:
Grasscare: £58.75 Holme Parish Hall: £26.00
6.6.2 Children’s Play Area: Re-surfacing has now been completed and the Play Area is again open. The Chairman commented on the excellent surface which has been installed.
6.6.3 Notice Boards & White-lining on ‘The Square; This work is now completed and it was resolved to pay the amounts due when invoices are received.
6.6.4 The Clerk requested that the following be included in the Minutes: (Approx. costs in brackets):
Work carried out in the village during 2009-2010 included two Bus Shelters (&7,000); re-surfacing ‘The Square’(£5,000 to £6,000): white-lining & new & refurbished Notice Boards on ‘The Square’ (£1,000); re-surfacing of the Children’s Play Area (£9,000) and Village Fireworks Display on November 5th (£300). None of the above were a charge on the Parish Council Precept and were covered by Grant Aid or donations from various bodies including Amey Mouchel; United Utilities; Cumbria County Council; The Russell Armer Fund; Holme Park Quarry & Lishman & Sons. All these grants were received as the result of a great deal of work on the part of Holme Parish Council.
6.6.5 Parish Council Accounts The Accounts for the Year 2009/2010 having been circulated to Cllrs, these were accepted unanimously. The Council also discussed the Annual Governance Report and agreed unanimously that the Council had carried out all its duties as set out therein. The Chairman signed the Annual Return for the year which will be forwarded to the Audit Commission. The Chairman and Council thanked the Clerk for all her work during the year and for the preparation of the Accounts. It was confirmed that no matters had been raised by the Audit Commission for the Year 2008/2009.
10.6.7 Parish Council Surgeries:
6.7.1 There were no residents in attendance at the Surgery held on Saturday 16th May.
6.7.2 Date of next Surgery: Thursday 17th June.
6.7.3 Cllrs Gibbons & Wragg will attend.
10.6.8 To resolve on action to be taken in regard to the following Village Matters:
6.8.1 Council-owned Seats; benches; bus shelters etc: The 3-monthly report has been received from Cllr Wragg and the only work required is sanding on two of the seats. Cllr Parker asked Cllr Duckett to look at the new seat at the North Road end of the canal as this was possibly in need of some work.
6.8.2 Sycamore Tree: Cllr Duckett, the Tree Warden, reported on a meeting with Capita to discuss removal of this tree as it was regarded as unsafe. The tree has now been removed and a local resident has offered to plant another tree in its place.
6.8.3 Dog-fouling Notices: Still awaited. The Chairman will contact SLDC again.
6.8.4 Parish Paths: The Council has now decided on the work which needs to be carried out to the path at the rear of Pear Tree Park Estate and the Chairman will discuss this further with Martin Nicholson of Russell Armer. The Clerk will contact Andrea Bonacker of Cumbria CC in order to arrange a meeting to discuss this path and complete the necessary forms.
6.8.5 Local Area Partnership: For the time being the Council will attend meetings of the Partnership although some doubts have been expressed about its usefulness. The Council’s representatives will be Cllrs Parker and the Chairman.
6.8.6 Sub-Station – North Road: The humming noise which appears to come from this sub-station is being investigated.
6.8.7 Dropped Kerbs: Further finance is not available at present. Martin Elson of Highways confirms that he has traced a route from north to south of the village which is poss8ible using dropped kerbs already in place.
6.8.8 Parked Vehicles: The vehicle on Milnthorpe Road has now been removed. The Chairman will speak to the Police regarding the vehicle which is considered to be a danger to vehicles emerging from Hillside.
6.8.9 Raised area of ‘The Square’: Moss killer suitable for use on tarmac will be purchased and the Lengthsman will see whether this is successful in removing the moss in this area.
6.8.10 Road Closure in Burton: Although this road closure is in Burton Parish, Keith Masser of Highways will be asked what arrangements have been made for the bus services during the closure period in August.
6.8.11 Footbridge over stream in Pear Tree Park: Despite objections from some residents, the Council considers that, as this footbridge was shown on the original plans which were submitted to the Council, it should be built. If necessary, the new bridge could be a much simpler construction than that shown on the original drawings.
